Terms and conditions
These terms describe your relationship with us and your use of our website. They are legally binding, and you accept and agree to them by using this website. These terms change from time to time, so please read them carefully each time you use this website. Your attention is drawn to the section below entitled ‘Restrictions on our liability’, as it restricts our liability to you – even if we are negligent. Your statutory rights as an individual buying something which is not for use in a business are not affected by these terms.
English is the only language used on this website
Interpretation
In these terms:
‘us’ and ‘we’ mean direct farm supplies Limited.
‘including’ and ‘in particular’ are used to illustrate particular examples, but they do not limit the scope of these terms in any way.
‘loss’ means any loss or damage of any kind. It includes: (i) associated costs and expenses incurred in connection with any loss or damage or any related claim or legal proceedings, and (ii) compensation paid to third parties.
You: You confirm that:
you are accessing our website from within the United Kingdom
you are over 18 years of age
you are using your own payment card.

The address you provide is the one that we will ship to whether it is correct or not.

you are resident in the UK at the delivery address you give in the order form. If any of these are not true, you will compensate us in full for any loss we suffer as a result.

Information services
This website includes information which we have sourced from third parties and which we make available free of charge. We have taken reasonable care when selecting those third parties, but we have no control over the information itself and we do not accept any responsibility for its accuracy.
Our products
The pictures on this website are for illustrative purposes only, and the items delivered may be different in detail. For example, they may be a different colour. Some items may not be available, in which case we may substitute an appropriate alternative. We may change our prices at any time, although this will not affect any orders we have already accepted.
Order process
You may only order items by adding them to your electronic ‘basket’ and then proceeding through the electronic ‘checkout’. Further instructions will appear at each stage, and any charges you will have to pay will be clearly identified. Your order will be acknowledged when you submit it, but this does not mean that we have accepted it. Each item in your order constitutes a separate order. If we accept your order for all or any of the items, we will send you a further e-mail saying so. If we accept your order there is a legally binding contract between you and us.

It does not include anything else. Nothing on this website amounts to an offer to supply any items, and we are not obliged to sell you anything until we accept your order. We may decline to accept any order, or any part of an order, without giving any reason.
You may be required to help us verify your age before we accept your order for certain items.
Payment
You must pay when ordering in pound sterling only. You may pay for most items using most widely accepted credit or debit cards. Payment in connection with this website is subject to the general account terms.

stock

stock levels are changing all of the time so there may be times when something shows in stock but isn’t. In which case we’ll let you know when we have more in stock ready for collection.

always wait for confirmation of collection ready before coming to collect.

Abuse

Any abuse in any form including strong and derogatory language to any of our staff whether on the phone, in person or in an email will result in termination of the order or telephone call.

Delivery

We’re currently not offering courier deliveries.
It is the buyers responsibility to select the correct delivery method from the list shown at checkout and provide the correct address.
We try to deliver all items within 2 to 3 working days (ie excluding Saturdays, Sundays and Bank Holidays), but longer delivery times apply to some items and this will be stated where this applies. We will try to deliver items the next working day if you select ‘express delivery’. We may deliver the items we have agreed to supply at different times. Order before 12.00pm to ensure best chance of next day delivery if item is in stock. We usually deliver by courier. We only deliver items to addresses within the UK excluding Jersey and Guernsey and scottish highlands. We reserve the right to deliver them only to the address identified with the card or account you have used to pay.

Next day is from despatch not order.

Our obligation to deliver the items is fulfilled when someone first tries to deliver them at the address you have specified in your order so long as the correct delivery method and address is chosen by the buyer, this includes a card being left
You must report any errors or damage which are apparent at the time of delivery to the carrier. For more information about delivery charges please see The Delivery Information Page.
Saturday delivery is a available at extra charge

If you provide us with an incorrect address it is the buyers responsibility, we do not google or research any address before sending.

All courier deliveries will require a signature and will be delivered between 7.00am and 6.00pm, if you feel this is to much of a window then please don’t order.

The local delivery method only covers Gloucestershire postcodes (excluding GL1). Orders with an address outside of Gloucestershire using the local delivery option will be cancelled and they may incur an admin charge before a refund is made
Any items returned from failed delivery attempts will incur additional charges.
Cancellation
You may cancel your purchase within the cancellation period without having to give any reason, and we will refund the full price of the item (and all VAT and delivery charges associated with that item) to the card or account you used to place your order. The cancellation period begins the day after you have received the item concerned and lasts for 7 working days. To cancel, you must notify us by telephone, letter, e-mail. If you do cancel your purchase, you must return the unwanted item to us.
Unless the item concerned is one we substituted for the item you ordered, you must return at your own expense and if you require us to collect it from you we will charge you for the costs involved. You must take reasonable care of the item until it is returned to us, and we may charge you for any damage if you do not.
We may cancel your order for an item at any time before it is delivered to the delivery address if we have made a mistake in the price for that item quoted on this website and a reasonable person would have realised that we had made such a mistake – such as where the price quoted is unusually low and it is not clear from the accompanying message that this was intended. If we cancel your order, we will refund the full price of the item (and all VAT and delivery charges associated with that item) to the card or account you used to place your order, but we do not have any further liability for cancelling (with the exception of buyers using the local delivery or collection method outside of the local delivery area of Gloucestershire).
All orders awaiting collection must be collected from our store in Gloucester within 5 working days or the order will be cancelled and a restocking charge will be taken before making any refunds

Collection

You are welcome to collect your order once we’ve confirmed that your order is ready, from our store in Quedgeley near Gloucester, GL2 4AL. Direct farm supplies is open from 10.30-4.30pm monday to friday and 10.00-2.00pm on saturdays.

If collection is displayed at checkout without any other options this means you have a collection only item as part of your order I.e. dairy chemicals or large items. This will also be displayed in the product description.

We’ll let you know when your order is ready for collection so please await confirmation before collecting.

Completing any order with this delivery method selected will mean that we are expecting you to collect from us irrespective of the address provided and that you are aware of this.

cash on collection
cash on collection doesn’t guarantee your order, if items have not been collected with 24 hours of order being placed, we will let items go for sale to paying customers visiting our shop.

Restrictions on our liability to you

These terms cover our liability for loss of the kind described, no matter what may be the legal basis for our liability and even if it results from our negligence.
Our products are not sold for re-sale.
We are not liable for any business related loss of any sort, whether loss of goodwill, revenue, profit or expected savings.
We are not liable for any loss resulting from the late despatch or delivery of any items.
If we do not despatch or deliver an item at all, we will refund the price of that item (and all VAT and delivery charges associated with that item) to the card or account you used, but we are not liable for any other loss.
Our total liability in connection with an item is limited to the total value of that item, including all taxes and delivery charges relating to that item. 11) We are not liable for any loss resulting from your reliance on any of the information services provided via this website.
Notwithstanding anything else in these terms, we do not restrict our liability:
for any personal injury resulting from negligence (whether or not it results in their death)
under Part 1 of the Consumer Protection Act 1987 if we do not have the right to sell an item when we send it to you (but see above concerning software, which is only licensed)
for fraud.

Using products for non intended species i.e. sheep colostrum for goats or puppies is the responsibility of the buyer, any effects occurring from improper use falls solely with the buyer.
Events beyond our control
We are not in breach of our contract with you, or liable to you in any way, if we fail to perform our obligations, or are late doing so, because of something that is beyond our reasonable control.

This website contains links to other websites. These are provided for your convenience but we do not endorse any of those websites or their operators, or give any assurance about them. We are not liable for any loss which results from your use of those websites. We are not responsible for the privacy practices they follow and you should read the privacy statements of each website you visit.

We take reasonable precautions to try to ensure that this website and our e-mails are free from computer viruses and other harmful programs, but we do not give any assurance that they are and we are not liable for the consequences of any which might be present. It is your responsibility to take appropriate steps to protect your computer against these – for example, by using up-to-date virus-detection software.

We own these intellectual property rights, or they are licensed to us, and we prohibit any activity which would infringe these rights. Our contract with you is governed by the law of England and Wales and only the courts of England and Wales are entitled to decide any dispute arising out of the contract.
Shipping and Returns
How long will my delivery take?
Our aim is to deliver all stock items ordered within 2 – 3 working days. We will contact you by email if there are any unexpected delays.
How much is the delivery charge?
A delivery charge will be calculated based on the the overall weight of the order To obtain an exact delivery cost please place the items you are interested in buying in your basket, then click view basket to obtain a total price. You are not required to supply any personal information to obtain a quote in this method.
some items have quantity limits per order ie animal feeds maximum of 2 bags per item.
spend £150.00 excl vat and up to 20kg for free delivery (exclusions or additional charges may apply)

It is the buyers responsibility to select the correct delivery method from the list clearly shown in the checkout Ie if you are outside of the local delivery area of Gloucestershire then you should select the weight based option not the free or local delivery options if they are shown and also provide an address which is correct.

Local delivery is for Gloucestershire only and is free within 10 miles of our store in Quedgeley GL2 4AL.

If you select local delivery and you are outside of Gloucestershire, your order will be cancelled and may incur an admin charge which will be taken before a refund is made.

If your order doesn’t qualify for free delivery (£150.00 excl vat or more) but is shown then don’t select it 

Collection

Before coming to collect

General
Images are shown for illustration purposes only and packaging may vary due to changes made by our suppliers.
We make it a priority to ensure all items for sale in the direct farm supplies web site are in supply, and that you get what you have ordered. If for any reason an item is out of stock, or we do not receive something from the producer in time for our delivery deadline, we will notify you of when we expect to be able to deliver your order. If you do not wish to wait for the late delivery you have the right to cancel your order for that item and you will be credited in full for it.
Deliveries are only available to UK Mainland Addresses
Orders placed with the intention of export are done so at the buyers own risk. Direct farm supplies holds no responsibility for these items regarding import/export charges and any disputes that arise from not adhering to a countries legal terms.

RETURNS
The Website operates a fair policy of accepting returns provided the goods and their packaging are received back by us within 7 days in accordance with the following guidelines:-
Please advise us by email to sales@directfarmsupplies.co.uk within 7 days of delivery that you wish to make a return and quote your order number.
We will send you details of the correct address to use.
Ensure the packaging and goods are returned to us in “as new” condition. Damaged or used goods cannot be refunded.
When the goods are received your credit card will be credited with the cost of the item returned.

Special orders for non stock items and animal feeds will not be able to be returned.
Order processing
The Website enters into a contract with you only when we send you an e-mail confirming despatch of your product and accepting your order. Such contract will be deemed to have been concluded in the United Kingdom and will be subject to the interpretation and enforcement of UK Law under the jurisdiction of the English Courts. Whilst your card may be debited before the contract is formed, a full refund will be made immediately if your order is not accepted.
Users outside UK
This Website is owned, controlled and operated by direct farm supplies Ltd from its office within the United Kingdom. direct farm supplies Ltd makes no representation that materials in the Website are appropriate or available for use in other locations, and access to them from countries or territories where their contents may be illegal is prohibited. Those who choose to access this Site from other locations do so on their own initiative and are responsible for compliance with applicable local laws. Any claim relating to the use of this Site and the materials contained herein shall be governed by United Kingdom law.

Any abuse in any form towards any of our staff will result in the order being terminated.

Revisions

Clearance items

Items in the clearance  catagory are either slow moving items or items close to or past  there best before date and are usually discounted for this reason. Items past the best before end date are fit for use as intended and buyer is aware of this when ordering. Refunds will be at Direct farm supplies discretion if the buyer decides they no longer want the item because of this.

Again local delivery option only covers Gloucestershire addresses and orders will be cancelled if they are outside of Gloucestershire. Please select weight based shipping.
